A Last Will and Testament is a document where you identify the beneficiaries (individuals or charities) to receive your assets after the payment of your final debts and expenses. Your Last Will and Testament also nominates a Personal Representative. Through the probate process, the Court appoints your Personal Representative, who will collect your assets, satisfy your final debts and expenses with your assets, and distribute the balance of your assets to your named beneficiaries. If you have minor children, under your Last Will and Testament, you may appoint a Guardian of the person and a Guardian of the property for your children under the age of 18.  Back to Wills, Trusts and Estate Planning
